NA resolution
on deposed judges won’t be binding: AG

ISLAMABAD—Attorney General of Pakistan (AGP) Malik Muhammad Qayyum has
said any parliamentary resolution on reinstatement of judges can be
nothing more than some one desire and it can not be binding in any way
as Supreme Court (SC) has already given its verdict on deposed judges,
says a private TV channel here Thursday.
He held no transaction other than oath taking of members-elect and
election of speaker and deputy speaker can be conducted in the first
session of national assembly. The oath taking and election of speaker
and deputy speaker will take place in conformity with the constitution,
he added.
Due to 8th amendment president Musharraf will invite a leader to form
government who will show his majority in the house in the inaugural
session of national assembly, he told.
It is obligation of governor to convene session of provincial assembly,
he said adding PCO stands undone on December 16. Constitution is fully
operational and the governor will summon provincial assembly as per
constitution, he told.
Attorney General of Pakistan Malik Qayyum said under the constitution
the first session of the National Assembly would be convened to take
oath from newly elected members and elect the Speaker and Deputy Speaker
of the House.
In an exclusive discussion with Geo news at Attorney General’s office on
Thursday, Qayyum said the President of Pakistan used to invite the
leader of the majority party to form government but after the 8th
Amendment, the President, under the constitution, would ask the member
to form government, getting majority support in the House.
Responding to a question he said the President has the authority to
convene NA session to elect the House leader but no time frame could be
given for that. However, he said, if one fourth majority of the members
gives requisition, the session can be convened.
Answering another question Qayyum said Judiciary of November 2 could be
restored by a single resolution since the Supreme Court had already
reviewed its legal status.
He said government had no plans to file reference against any such
resolution in the Supreme Court. He said Chief Justice Abdul Hamid Dogar
neither wrote any letter to the President under article 190 nor
expressed any such intention.
Refuting rumours regarding Aiwan-e-Saddar having talks with Political
Parties for restoration of Judges, Presidential Spokesman Rashid Qureshi
on Thursday underlined that Restoration of Judges is not possible
without making amendments in the Constitution.
While talking to a private TV, Presidential Spokesman Rashid Qureshi
made it clear that no such talks are taking place with political parties
adding that such rumours are fuelling fire and creating doubts over
people’s minds.
He said that restoration of deposed judges is not possible without
amending the constitution however only constitutional experts can give a
clear cut view in this respect.
He further said that according to his knowledge, all such news regarding
Aiwan-e-Saddar having talks with Political Parties for restoration of
Judges is concocted..
