Ombudsman aks FBR to rescind order in original

ISLAMABAD—Federal Ombudsman Justice (retd) Munir A. Sheikh has asked Federal Board of Revenue to rescind order in original served on the complainant by the Collectorate of the Sale Tax, Faisalabad. This decision was taken by the Federal Tax Ombudsman on the complainant M/S N Tax, Faisalabad against Collectorate of sales tax, which rejected claim of refund for Rs270,443 through sale tax order in original. The FTO ruled that SCN was not a valid service. Thus, the very basis on which the order in original was passed, stood rejected. The FTO recommended to the CBR to rescind the o-i-o because it was passed without any basis, give the complainant a fresh opportunity to prove his refund claim, notify the guidelines in the official gazette and the compliance of the recommendations should reach this office within 45 days of their receipt by the Chairman, FBR.—Online
