Parties have
lost trust: ex-CJ

PESHAWAR—Deposed judges of Peshawar High court including deposed chief
justice Tariq Pervez Khan have said nation has lost confidence on
political parties adding those who chant slogans against president
Musharraf in the light of day support him in the darkness of night. They
said this while addressing lawyers convention held here Monday under
Peshawar High Court Bar Association.
Deposed PHC chief justice Tariq Pervez said this country was not only of
politicians and political parties but it was also country of 160
millions people. President Musharraf and the Supreme Court comprising
the judges who have taken oath under PCO have no right to make amendment
in the constitution, they announced. President Musharraf on one side
considers him above constitution and on the other hand he gives
impression of taking oath under constitution, they noted.
They told the orders for promulgation of PCO came from cabinet division
through fax. Telephone call was also made that judges should come to
high court to take oath under PCO. “The nine judges among the members of
the team of PHC of which he was leader took oath under PCO and I am very
ashamed of this act but I am proud of my three associates who did not
take oath under PCO, justice Tariq Pervez said.
Judiciary was targeted for the very reason that chief justice of
Pakistan secured recovery of 186 missing persons, he held. Justice Dhost
Muhammad Khan blamed Musharraf for creating distance between the army
and masses. Justice Ejaz Afzal in his address has said that the game of
politics is not the game of feudal lords. Lawyers should also come
forward and take part into the politics.
The ousted judges were also awarded medals on behalf of Peshawar Bar
Association. President Peshawar High Court Bar Association, Abdul Latif
Afridi and Acting President Akhtar Boland award gold medals to the
deposed CJ, Tariq Pervez, Justice Shah Jahan Khan Yousafzai, Justice
Ejaz Afzal and Justice Dost Muhammad Khan. Deposed Chief Justice of
Peshawar High Court, Justice Tariq Pervez Khan said on Monday that the
Constitution empowers no individual to amend the document rather it is
the discretion of the masses through their public representatives.
Addressing a provincial lawyers’ convention at the lower courts which
was also attended by other deposed judges of Peshawar High Court
including Justice Shahjehan Khan, Justice Dost Muhammad Khan and Justice
Ejaz Afzal Khan, Mr Tariq said that parliament is supreme body which
reflects aspiration of 160 millions people and the constitution empowers
parliament to amend any law or section of the constitution. Former Chief
Justice Sindh High Court Justice (retd) Wajihuddin has said that people
of Pakistan want the rule of law and restoration of constitution in the
country. He was addressing at the seminar on” Reforms and human rights”
organized by Joint Action Committee to mark an international human
rights day being celebrated throughout the globe on Monday (today) held
here at Hyderabad Press Club.
The former Chief Justice Sindh High Court said that people of Pakistan
was struggling for having rule of law in their country. He expressed his
reservation over the claim of government for holding of upcoming
elections in a free and transparent manner without lifting emergency and
restoration of constitution.
He said that sacrifices of law fraternity will ultimately yield positive
result in the country. He did not rule out the formation of party namely
Justice Party in future. He hoped that some day the labourers and
workers of the country will get their due rights. Other speakers who
addressed the seminar included Hussain Bux Thebo, Hoat Khan Gadhi, Fazal
Waqar, Zain Daudpoto, and Sehar Rizvi.(Fist), PKMAP (Tree), Pakistan Democratic Party (Umbrella) and JUI Samiul Haq
