LHC suspends Misbah’s repatriation

LAHORE—Lahore High Court (LHC) on Monday stopped 12-year-old Scottish-Pakistani girl Misbah Irum from being sent abroad with her mother till December 08, 2006.
Earlier, n November 29, Justice Saqib Nisar of LHC ordered Misbah Irum, who cam to Pakistan with her Pakistani father three months back from Scotland, to be handed over to her Scottish mother Louise Ann Fairely within seven days for being taken back to Scotland. Misbah’s Pakistani father Sajjad Rana later filed an Intra Court appeal before a dual bench of LHC comprising Justice Azmat Saeed and Justice Atta bandyal against the previous decision and appealed to suspend the previous decision for the time being. Hearing the Intra Court appeal on Monday the Dual Bench remarked that an Intra Court appeal can not be filed against High court judge’s decision in a habeas corpus case. However, Sajjad Rana’s council pleaded that this was not a habeas corpus case but a case of hand over, that’s why an Intra Court appeal can befiled before the same court. The dual bench however adjourned hearing till December 08.
