CBR asked to decide case of an importer under Custom act

ISLAMABAD—Federal Tax Ombudsman (FTO) Justice (Retd) Munir A Sheikh has directed the Central Board of Revenue (CBR) to decide the case of an importer in according with Custom Act.
The decision was taken by the FTO on the complaint of MS Pak Telecom Mobile Ltd Islamabad against the issuance of a demand cum show cause notice by Custom Authorities, Karachi, regarding payment of additional duty on imported consignment of Telecommunication equipment.
The FTO has observed in his decision that there is no justification under the custom law to demand additional duties from the complainants on account of the mal administration of Customs for delay in the encashment of Bank guarantee and demand cum show cause notice has no legal validity. The FTO has asked the CBR to withdraw the notice with in 15 days investigate the reason, due to which abnormal delay took place in cashing the Bank guarantee and take appropriate action against the official responsible for mal administration and compliance in this regard be reported to this office within 45 days.—Online
