SC allows a divorced woman to lead life of her free will

ISLAMABAD—Supreme Court while allowing a woman resident of Taxila to live her life according to her free will has imposed fine to the tune of Rs 10000 on her former husband for filing false applications against her .
One Ghulam Abbas resident of Taxila who is employed in Wah factory submitted application to the chef justice of Pakistan stating that his wife had been abducted adding he suspected that she had been murdered.
Chief Justice while taking suo motu notice ordered Rawalpindi police for recovery of the woman.
Police presented Baliqis Akhtar on Friday before the court. The applicant Ghulam Abbas, SP Investigation Rawalpindi, Dr Azam and additional advocate general Punjab Chaudhry Muhammad Hussain appeared before the court.
The SC bench which heard the case comprised chief justice Iftikhar Muhammad Chaudhry and justice Muhammad Nawaz Abbasi.
Police informed the court that Balqis Akhtar was caught while seated in a car with one Asif near Margalla Jail post.
The court asked Balqis Akhtar where she was living and why her husband had filed application against her.
Balqis Akhtar told that Ghulam Abbad had divorced her and he had registered a case of zina by leveling false accusation of adultery. " I was bailed out after spending two months in jail, she added. I am living with a family in Rawalpindi and I don't about this family, she told. My relatives had got me released on bail.
The court asked Ghulam Abbas as to why he filed false application. He submitted Balqis Akhtar was giving false statement. I had caught her red handed with a man, he informed. I had not divorced her , Ghulam Abbas stated.
Chief Justice while addressing Ghulam Abbas said " your are liar . Why are your debasing her when you had divorced her.
The court on the request of Balqis Akhtar that she is independent and can live any where with her sweet will allowed her to lead life of her free will.
The court however directed the SP to keep a watchful look on the matter so that the woman could not fall to the snares of police.
The court appreciated ASP Ejaz Khan for so early recovery of Balqis Akhtar.
The court imposed fine of Rs 10000 on Ghulam Abbas for filing unfounded application and ordered him to deposit this amount with the registrar Supreme court. This amount be given to Balqis Akhtar, court ordered.
